Terms of Service

Welcome to Notta Socket. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). These Terms are a legal agreement between you and Notta Boss Limited, a New Zealand company.

1. The Service

   Notta Socket provides a real-time WebSocket infrastructure service. We strive for 99.9% uptime, but as with all cloud services, we cannot guarantee uninterrupted service at all times.

2. Accounts
   • You are responsible for maintaining the security of your API keys and secrets.
   • You must provide accurate billing information.
   • You may not use the service for any illegal purpose or to transmit illegal content.
3. Usage Limits & Capacity

   Notta Socket operates on a Reserved Capacity model.

   • Quotas: Your plan defines your Maximum Concurrent Connections and Maximum Daily Messages.
   • Enforcement: If you exceed your Connections limit, new connections will be rejected. If you exceed your Messages limit, new messages will be dropped.
   • Responsibility: It is your responsibility to monitor your usage and upgrade your plan if necessary to prevent service interruption.
4. Fees and Payments
   • Subscription: Services are billed monthly in advance.
   • Proration: If you upgrade or downgrade your plan mid-cycle, charges will be prorated automatically based on the time remaining in the billing period.
   • Taxes: All fees are exclusive of taxes, levies, or duties imposed by taxing authorities. You are responsible for paying all such applicable taxes (including, but not limited to, New Zealand GST or international VAT/sales tax) which will be added to your invoice where required by law.
5. Refund Policy (The "First Month" Guarantee)

   We want you to be happy with our craftsmanship.

   • First Month: If you are dissatisfied with the service for any reason within 30 days of your initial sign-up, you may request a full refund of your first month's invoice.
   • Subsequent Months: After the initial 30-day period, we do not offer refunds for partial months of service. You may cancel at any time, and your access will continue until the end of your current billing cycle.
6. Acceptable Use

   You agree not to use Notta Socket to:

   • Transmit viruses, malware, or harmful code.
   • Conduct Denial of Service (DoS) attacks.
   • Stream content that violates the intellectual property rights of others.
   • Attempt to reverse engineer the Notta Socket software.

   We reserve the right to terminate accounts that violate these rules immediately and without refund.

7. Intellectual Property

   You retain all rights to the data you transmit through our service. Notta Boss Limited retains all rights to the Notta Socket infrastructure, code, and branding.

8. Limitation of Liability

   Read this carefully.
   To the maximum extent permitted by New Zealand law:

   • Notta Socket is provided "as is" and "as available."
   • Notta Boss Limited shall not be liable for any indirect, incidental, special, or consequential damages (including loss of data or profits).
   • Our total liability for any claim arising out of these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Changes to Terms

   We may update these Terms from time to time. If we make material changes, we will notify you via the email address associated with your account or by posting a prominent notice on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

10. Governing Law

    These Terms are governed by the laws of New Zealand. Any disputes arising under these Terms shall be resolved in the courts of New Zealand.
